The 14th Amendment, Section 3, U.S. Constitution. By Gene W. Edwards. Posted 1/26/2024.
“Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”
As I read the above, I wonder who/what imposes the penalty of “No person who . . . .” A state’s attorney general should be enough. Donald Trump is not the only one who engaged in the 1/6/2021 insurrection. There were 100s, plus election deniers, conspirators, members of congress, etc. How could anyone doubt that Trump inspired the insurrection — to take power? Why would you want a seditionist ruling you?
I’m sure the Supreme Court will rule the states cannot remove Trump from their ballot. Hmm. I thought the nine justices on our court all knew how to read? If Trump is removed from the ballot in, say, two or three swing states, the game should be over: Trump loses.
If we don’t remove him from access to power, what will he try the next time?
Love,
Gene.
